crossing the Rubicon

https://thefederalist.com/2020/11/17/if-americans-can-no-longer-trust-our-elections-were-in-big-trouble/

The court-won destructions of state election law smacked Republicans  as nakedly political. Nobody seriously believes that allowing mailed  ballots to come in after the election has anything to do with actually  protecting people from the pandemic, especially when the same officials  applauding mail-in balloting have selectively applied coronavirus restrictions to reward their friends and punish their political enemies.

Democrats have compared Trump to Adolf Hitler and have widely called  his supporters white supremacists and fascists. If they believe half the  things they are saying about Trump or his supporters, why wouldn’t  massive vote fraud be justified and even moral?

The same people who ranted about Russia hacking the 2016 election—to the point where almost 70 percent of Democrats falsely believed that Russia had hacked and changed vote totals—tell  Trump’s base that it is dangerous and unpatriotic to doubt the results  of this election.

Russia, via a so-called troll farm, spent less than $100,000 on social media advertising before the 2016 election, but that didn’t stop House Democrats and many  Senate Republicans from treating this spending like it was the biggest  problem this country faced.

The censorship of any post questioning any part of the election on  social media and the denial and dismissal of obvious signs of fraud only  add fuel to the fire. These fly in the face of common sense. Consider  an article from the BBC in September 2016, about vote rigging in Africa. The article says that  classic signs of fraud include “high turnout in specific areas,” and  “delay in announcing results.” Note that states like Florida had high  turnout, but it wasn’t hugely concentrated to certain areas and ballots  were counted instantly.

But if Trump loses his court challenges and recounts, his supporters  aren’t going to forget about this. People are angry unlike anything this  author has seen before. The Jeffrey Epstein affair, the FBI corruption,  and the riots have completely eroded trust in basic institutions,  especially on the right.

If the fraud alleged did occur, it was pre-planned, industrialized,  and brazen. This isn’t 1960, where John F. Kennedy received more votes  in Cook County than the number of people living there. It isn’t 2000,  where a legal battle is ensuing over one state’s balloting issues.

This is an allegation that there was massive fraud, on a scale never  seen before—and the allegation comes from about 50 million Americans.  The allegation is plausible because the establishment denying it has  hated Trump and his supporters from the get-go. Trump supporters deserve  to be paranoid—they have been neither accepted nor understood.

Overall, people feel like America has been sliding for decades, and indeed the American working class has been  sliding for decades. If people begin to feel like elections no longer  matter, the only avenue to settle differences is through force and  violence. The far-left in this country has already skipped belief in the  electoral system and reached this conclusion. How else does a divided  people settle disputes without the ballot box?

The phrase “crossing the Rubicon” refers to the moment Julius Caesar  crossed the Rubicon River, which precipitated the Roman Civil War and  the end of the Roman Republic. It’s like saying “the point of no  return.” People can laugh at what this is implying, but America is  reaching a dangerous point if the people—on both sides—no longer trust  elections.

anti-Asian discrimination

The Democrat party is the party of anti-Asian discrimination.

https://www.wsj.com/articles/the-duo-that-defeated-the-diversity-industry-11605904415

No on 16 had to overcome a vast funding disparity. Whereas the referendum’s backers had a war chest of $27 million, “we raised a little over $1.7 million,” Ms. Wu says, “and nearly all of our funds came from 7,000 Chinese-American donors of modest means.”

Asians are harder hit than whites by racial preferences in higher education; Ms. Wu estimates their admissions to UC schools would have fallen as much as 50% if Proposition 16 passed.

When an NBC reporter raised this point with a Democratic state senator, he shrugged it off: “Black and Hispanic people have even greater concerns.”

The Yes campaign received $6.5 million from a single donor—Quinn Delaney, chairman of the Oakland-based Akonadi Foundation, which says it aims to “eliminate structural racism.” The largest contribution received by No on 16 was less than 1% as large—$50,000 from Students for Fair Admissions, a nonprofit group that has sued Harvard, alleging that it discriminates against Asians.

“Patricia Quillin, wife of the Netflix CEO, gave $1 million,” Ms. Wu adds, then goes on to list other givers of “big sums”: the California Teachers Association, Blue Shield, the Pacific Gas & Electric Co.

Other donors include Steve Ballmer, former CEO of Microsoft, as well as owners of the San Francisco 49ers, the San Francisco Giants and the Los Angeles Dodgers. By contrast, Ms. Wu says, the lone $50,000 donation accounted for “only 2.9% of our funds.”

Ms. Wu came to the U.S. in 2009 from Wuxi, population five million—“a small town by Chinese standards.” She earned a doctorate in international studies from the University of Miami and was “perplexed” when it dawned on her that Asians, “as a group, are being scapegoated in education to fulfill a narrative of very shallow diversity.” It shocked her to discover that America wasn’t living up to its ideals as a “land free for everyone.”

She hears from parents in New York’s Chinatown who fear their children will be squeezed out of the city’s specialized public high schools because of their leftist mayor’s push for “diversity.” They tell her that they worry their kids will be unable to “redeem the American dream.” These are poor parents who don’t speak English and have told their children: “You work hard, you study hard, you’re going to get out this ethnic enclave. You’re going to get out of Chinatown.”

When politicians and school administrators say there are “too many” Asians in elite classrooms, “I feel minimized,” Ms. Wu says. “I feel stigmatized that I was reduced to a racial box—that my hard work is being blamed for the lack of so-called proportionality in these institutions.”

Mr. Connerly, listening, can’t contain himself. “I have a more visceral reaction,” he says. “I am repulsed by that kind of language, because I have lived it. That’s what’s wrong with prejudice. You don’t see people as individuals.”

Mr. Connerly describes the Asian-American fight for educational equality as “probably the truest civil-rights movement of our time.” The civil-rights movement in the 1960s, he says, “was about civil rights, yes. But it became about advancing the condition of black people.” That’s why “you have people who have accused me of not really being a civil-rights guy—because civil rights in their mind is Al Sharpton and Jesse Jackson. But those guys are race advocates.”

Mr. Connerly offers a test for whether people are “really pro-civil rights”: “It’s when they will defend the right of a white person—a white male—to be treated equal to everyone else.”

disparate treatment of Pennsylvania voters

Here is text from the actual complaint:

https://cdn.donaldjtrump.com/public-files/press_assets/2020-11-09-complaint-as-filed.pdf

“The right to vote is protected in more than the initial allocation of the franchise. Equal protection applies as well to the manner of its exercise. Having once granted the right to vote on equal terms, the State may not, by later arbitrary and disparate treatment, value one person’s vote over that of another.” Bush v. Gore, 531 U.S. 98, 104-05 (2000).

All citizens, including Pennsylvanians, have rights under the United States Constitution to the full, free, and accurate elections built upon transparency and verifiability. Citizens are entitled – and deserve – to vote in a transparent system that is designed to protect against vote dilution.

The right to vote includes not just the right to cast a ballot, but also the right to have it fairly counted if it is legally cast. The right to vote is infringed if a vote is cancelled or diluted by a fraudulent or illegal vote, including without limitation when a single person votes multiple times. The Supreme Court of the United States has made this clear in case after case.

See, e.g., Gray v. Sanders, 372 U.S. 368, 380 (1963) (every vote must be “protected from the diluting effect of illegal ballots.”); Crawford v. Marion Cnty. Election Bd., 553 U.S. 181, 196 (2008) (plurality op. of Stevens, J.) (“There is no question about the legitimacy or importance of the State’s interest in counting only the votes of eligible voters.”); accord Reynolds v. Sims, 377 U.S. 533, 554-55 & n.29 (1964).

The disparate treatment of Pennsylvania voters, in subjecting one class of voters to greater burdens or scrutiny than another, violates Equal Protection guarantees because “the right of suffrage can be denied by a debasement or dilution of the weight of a citizen’s vote just as effectively as by wholly prohibiting the free exercise of the franchise.” Reynolds, 377 U.S. at 555.

In a rush to count mail ballots and ensure Democrat Joe Biden is elected, Pennsylvania has created an illegal two-tiered voting system for the 2020 General Election, devaluing in-person votes. For voters that appeared at the polls, those citizens were required to sign voter registrations, have those signatures checked against voter rolls, vote in a polling place monitored by statutorily authorized poll observers, and have their votes counted in a transparent and verifiable open and observed manner.

By contrast, due to the arbitrary, unauthorized, and standardless actions of the Secretary of the Commonwealth of Pennsylvania, Kathy Boockvar, nearly 2.65 million votes were cast through a “mailin” process that lacked all of the hallmarks of transparency and verifiability that were present for in-person voters.

In fact, Secretary Boockvar affirmatively excised nearly every element of transparency and verifiability.

software errors and the election

There were some unintentional software errors.

https://www.palmbeachpost.com/news/recount-shows-wrong-winners-declared-two-wellington-election-races/ZYkE3PtNmVzMjDgXeydqFJ/

Bucher said a software problem caused the actual results of the mayor’s race to be initially reported as the results for the Greene-Hostetler Seat 1 council race. The true Seat 1 results were initially reported as the results for the Seat 4 race between Paglia and Willhite. And the actual Seat 4 results were certified to the state as the results of the mayor’s race.

Bucher placed the blame squarely on computer software. A spokesman from Dominion Voting Systems, which supplies the county’s voting and tabulating equipment, could not be reached Monday night.

“This is not a human error. This is a computer-generated error, one that is on a computer system that is tested and certified by the state of Florida,” Bucher said.

“I’m hopeful that people will hear the real story and not one that is generated by the media and they will understand that it is a software error. We have the engineers at the home office of Dominion looking into it,” Bucher said. “We’ve used the software since 2007 and this has never happened in Palm Beach County.”

The problem was uncovered when the elections office ran a routine audit Monday morning of results from all 16 municipalities that held elections March 13. When actual ballots from randomly selected precincts in each city were compared with the certified results, Wellington was the only municipality with a discrepancy, Bucher said.

Because of the audit, Bucher said she is confident that none of the other cities had discrepancies and that the results of past, similarly audited elections are accurate. She also said she’s confident that future election results will be accurate because she expects the county to get upgraded software.

the division of America

A TOTALLY DISENCHANTED DEMOCRAT SENT THIS. TRY TO PUNCH HOLES IN THIS! These facts speak volumes about the DNC.

The woman who researched and wrote this lives in Sedona Arizona and is a retired lawyer. She writes in simple language as a former Democrat to all Democrats in general:

Democrats –

Now I know you don't like President Trump. That’s a given, SO let's move on from that.

How about the division of America. Do you really blame Trump for that? How about when NONE of the DEMOCRATS showed up for his inauguration? Don't you think that started the division? He hadn't even been president yet, and EXCEPT for Clinton and Obama, not one Democrat showed up. Is that when Trump divided America? Can you imagine if the REPUBLICANS didn't show up for Obama's inauguration because they lost? Can you even start to imagine what would have happened?

How about when 19 minutes after Trump was inaugurated, the Washington Post declared the IMPEACHMENT CAMPAIGN has STARTED? Was that when Trump divided America?

How about when Nancy Pelosi ripped up Trump's state of the union right in front of the world, showing complete disrespect for the President of the United States? Did that bring the country together and is THAT when Trump divided America?

How about when America had to endure 3 years and over 30 million dollars spent on trying to PROVE that Trump only won because of RUSSIAN COLLUSION and NOT because America voted him in. And 17 democrats did EVERYTHING in their power to PROVE that there was Russian Collusion. and came up with ZERO? Was THAT when Trump divided America?

I can't even start to go over the NEGATIVE PRESS he's received since his surprise win. Remember, the DONORS, the likes of Bloomberg, who gave 27 million, Tom Steyer who gave 17 million, George Soros who gave 9 million and MANY MORE that gave MULTI-MILLIONS to Hillary, wanted a return on their investment. Do you really think that donors give MILLIONS UPON MILLIONS just because they love Hillary? NO, these weren't campaign donations, they were INVESTMENTS into what HILLARY had promised them when she became President. They were so sure she would win and they would be SHOWERED with HUGE RETURNS, and when it didn't happen and they LOST all those millions, they went all out to TAKE TRUMP out of OFFICE by any means possible.

DID YOU KNOW that 90% of the Mainstream media and the corporations that own them, are owned by or run by BIG DEMOCRAT DONORS? You can verify all of that for yourselves. I did. Since the moment Trump won, even before he was inaugurated, the mainstream media's reporting was 92% negative on Trump, do you know why? It was those big donors that lost their dream of MILLIONS of dollars, on their returns that they were going to receive when Hillary was President and they weren't going to take that loss lightly. They needed to PUNISH TRUMP and those that VOTED HIM IN.

I've said this since the night he was elected. "There is NOTHING the left won't do to take down our President”, our country and us, no low they won't go to, to get their power back", and sadly, we have seen this every single day since his election.

Let me ask you this. Have you ever listened to Trump or appreciated any accomplishment or campaign promises he's kept, have you ever gone to one of his rallies or have you just closed your mind to anything he does? Please ask yourselves the following questions, if you dare.

What has Joe Biden done for America for the last 47 years that he's held an office?

What did Joe Biden ever do for BLACKS when HE and Obama were in office?

What has Joe Biden ever done in his entire life to create a private-sector job?

What has Joe Biden done to help the American middle class worker?

Let me also ask you this. Why do you think there are so many people tearing down statues, our burning flag, beating up police officers, disrespecting our founders and hating our country? It comes straight from our SCHOOLS that have slowly been tearing down our history. If there is a teacher out there, please tell me the following:

Do you teach the truth that it was the DEMOCRATS that were the KKK?

That the GRAND LEADER of the KKK was Robert Byrd, who was elected to congress as a DEMOCRAT and served for decades, and that it was Hillary, Bill, and Obama that gave his EULOGY praising him?

That the DEMOCRATS fought the Civil war to KEEP SLAVERY? That the inner-city ghettoes were created by DEMOCRATS to keep control of slaves after they were freed?

That planned parenthood was founded in inner cities to CONTROL the BLACK POPULATION? Is any of this in your history books?

Let me ask you this as well: Can a student speak up when he/she disagrees with a teacher when they say that Trump is a horrible President or the electoral college has to be eliminated? I don't think so? Well, I know a student that actually happened to. When the teacher said it had to be eliminated because Hillary lost, and he stated the reason it should stay, she ripped him apart and gave the entire class a 5 hour test, and stated it was because he DARED to disagree with her. Is that happening in your schools?

I'm only asking questions. I'd like your answers.

President Trump and his entire family has been vilified, demeaned and disrespected, for one reason and one reason only. HE WON.

Have you noticed the DEMOCRATS only throw tantrums and OBJECT to everything he does and have NEVER ONCE gotten behind him to make America the best it can be? WHY? They can't afford to get behind him. he would WIN AGAIN, and they can't let that happen. if he wins again, the Democrat party will be destroyed and they know it.

Did you notice that the "CAGES" the left claimed that Trump built to put Illegal children in, WERE BUILT BY OBAMA for the very purpose of PUTTING ILLEGAL CHILDREN IN? Was THAT all over the news when Obama did it? The very same “CAGES". but the media was silent!

How about when Trump commuted Roger Stone's sentence, and was DEMONIZED 24/7 but NOT A WORD when Obama commuted 1,715 inmates, which included 330 that he granted on his last day in office. DID WE EVEN HEAR one WORD about it?

Were there reporters even reporting it. NO! Just look at the difference in the reporting. By the way, since Trump's been in office he's commuted 10 people. compare that to Obama. Is that reporting fair?

How about when Biden and Obama allowed the H1N1, the SWINE FLU, to INFECT MILLIONS of Americans before declaring it a health emergency. Was the press losing it's minds and calling it the OBAMA FLU AND BLAMING OBAMA and BIDEN for the spread? —— SILENCE!

Compare this to the NEGATIVE COVERAGE that Trump got when, he immediately halted travel from China. Then, in February, Nancy Pelosi went to Chinatown and said come on down, or when DeBlasio, in March, said ride the subways and go to Broadway. BUT those same people are blaming Trump for the spread of coronavirus.

A FINAL QUESTION:

What have the DEMOCRATS done to help make America the best, to get behind a president that works tirelessly to care about WE THE PEOPLE instead of using us as political pawns? What have the democrats done for people of color EXCEPT for GIVING ILLEGALS more rights than citizens and having us pay for it?

JUST imagine what this country could accomplish if the Democrats worked with him on the economy, the coronavirus, the inner cities where he's created opportunity zones, job training etc. When Trump tried to get school choice for inner-city students they ran Betsy Devos out!! The democrats running those inner city schools wanted no part of school choice. Have you ever wondered why it's cities that have been run, for decades, that have the MOST HOMELESS, the MOST CRIME, the most MURDERS, the worst INNER CITY schools, ARE ALL RUN BY DEMOCRATS?

If you haven't started asking yourselves those questions, maybe you should. As I said, my entire family used to be Democrats, but NOT ONE will ever vote for a Democrat again. They asked themselves the same questions and the answer was clear.

Kamala Harris truancy punishment

What would Kamala Harris do if she were president of the United States?

This is what she has done in the past, with less power.

https://www.huffpost.com/entry/kamala-harris-truancy-arrests-2020-progressive-prosecutor_n_5c995789e4b0f7bfa1b57d2e

On the morning of April 18, 2013, in the Los Angeles suburb of Buena Park, a throng of photographers positioned themselves on a street curb and watched as two police officers entered a squat townhouse. Minutes later, their cameras began clicking. The officers had re-emerged with a weary-looking woman in pajamas and handcuffs, and the photographers were jostling to capture her every step.

“You would swear I had killed somebody,” the woman, Cheree Peoples, said in a recent interview.

In fact, Peoples had been arrested for her daughter’s spotty school attendance record under a truancy law that then-California Attorney General Kamala Harris had personally championed in the state legislature. The law, enacted in January 2011, made it a criminal misdemeanor for parents to allow kids in kindergarten through eighth grade to miss more than 10 percent of school days without a valid excuse. Peoples’ 11-year-old daughter, Shayla, had missed 20 days so far that school year.

The law was the capstone of Harris’ yearslong campaign to get “tough” on truancy, the term for when a child consistently misses school without a valid excuse. Harris’ involvement began in the mid-2000s, when the future senator and 2020 presidential candidate was the San Francisco district attorney.

Harris had been disturbed to learn that a disproportionate number of the city’s homicide victims were high school dropouts, and that dropouts are more likely to become perpetrators or victims of crimes. Preventing truancy, she argued, was not just about the noble goal of ensuring every child’s education, but a matter of averting future criminals.

So it only made sense for the city’s top law enforcement officer to get involved. Harris filed charges against a handful of San Francisco parents whose elementary school-aged children were consistently missing school.

A few years later, she persuaded the state legislature to adopt harsher penalties for truancy. Under the new law, the parent or guardian of a young, truant child could face a fine of $2,500 or more — or one year in jail. Harris pushed hard for the law as she was running for attorney general, and it passed just as she won the election.

“We are putting parents on notice,” Harris said at her 2011 inauguration. “If you fail in your responsibility to your kids, we are going to work to make sure you face the full force and consequences of the law.”

AULR natural born citizen

https://aulawreview.org/blog/natural-born-citizen/

The First Congress’s inaugural uniform naturalization statute became law on March 26, 1790.  The 1790 statute is the only U.S. national law other than Article II to use the words “natural born citizens.”  The use of those extinct words, coupled with the fact that the 1790 statute was enacted only two years after the Constitution’s adoption by a Congress that included several members who had played leading roles the Constitution’s drafting and ratification, explains its rightful prominence in all existing accounts of the meaning of the Natural Born Citizen Clause.

The particular context in which the words “natural born citizens” are used in the 1790 statute, however, had nothing to do with presidential eligibility.  The phrase was used in a secondary part of the statute to designate certain persons born outside of the United States who did not have to apply and meet the residence, oath, and good character requirements for any other person born outside the United States to become a U.S. citizen.[366]  The statute’s primary purpose was to specify these “naturalization” requirements.

Original meanings are rarely ascertainable, but this case is a rare exception.  The relevant historical evidence, which was exhaustively reviewed in this Article—Constitutional Convention debates, English common law, natural law, law of nations, canonical Anglo-American treatises like Blackstone’s and Kent’s, the 1784 Maryland Lafayette statute, the 1790 U.S. Naturalization Statute—all lead to the conclusion that the original meaning of “natural born Citizen” in Article II refers to a person either born in the United States, or outside it to a parent in government service or to a U.S. citizen father.
